I have been hearing about some Eldorado member's notions regarding personal property rights with regards to having poultry/livestock on lots in Eldorado. I am compelled to speak to this because this issue is NOT about personal property rights.
Eldorado at Santa Fe is a non-profit corporation that is registered as such with the PRC (Public Regulation Commission of New Mexico). It is a legally incorporated subdivision with legal documents that are legally binding to all who CHOOSE to purchase a home here. Anyone who CHOOSES to purchase a home here is told this before they sign on the dotted line. It is the United States of America and in the USofA, we all have the freedom to live where we choose. If you purchased a home here in Eldorado, you CHOSE to live here and in doing so, you also CHOSE to live here and abide by our Covenants and governing documents. Subdivisions are popular because of their Covenants, as they enhance property values and preserve the quality of life for members as well as natural wildlife. It is not a choice for everyone, but, it is a choice everyone in Eldorado at Santa Fe made when they purchased a home/property here. There is only one point in having an Animals or Household Pets clause within Covenants...and that is to distinguish the fact that poultry/livestock (animals) are not allowed.
It doesn't matter if you call the animal a pet. If it is poultry/livestock, it is not allowed.
It is also the right and responsibility of members in Eldorado to protect our property values and community values for themselves and for all members by letting our Compliance Representative, Mark Young, know if they are aware of anyone in Eldorado who has poultry/livestock so Mr. Young can bring them into compliance.
I have to say that I disagree with the broad sweeping statement, "Subdivisions are popular because of their Covenants, as they enhance property values and preserve the quality of life for members as well as natural wildlife." Covenants and the way they are enforced can, in fact, be a significant detriment to property values. Inconsistent and arbitrary interpretation and enforcement, not to mention a officious and arrogant attitude in enforcement has has a significant negative impact on Eldorado property values. People know about the actions of the ECIA and won't won't move here because it it -- and the ECIA's arrogant idiocy is increasingly well known in the region, and will increasingly weight on property values here, not to mention the ability of property owners to enjoy their property.
ReplyDeleteQuite frankly, regardless of what side of the chicken issue you are on, you should be suing the ECIA for the ineptitude and their arrogant pushing of their own petty bourgeois attitude on the rest of us regardless of whether it is supported in the covenants or not.
Why do you hide behind a number instead of stating your name? Don't you have the courage for your convictions?> It is a free country. You can live where you like. If you choose to buy a home in Eldorado, you are buying into a privately owned subdivision that is owned by the people who own property here and you agree to abide by the legally binding Covenants that are attached to your property. As a property owner, you have the privilege to vote for what you want or don't want our community to be like and you accept that the majority rules...it is called democracy. Eldorado is not perfect. I disagree with lots of things, but, I have learned how important it is to pay attention and participate in the democratic process. I have met many wonderful people in Eldorado since I became more involved.....some, not so much, but, even with its imperfections, it is a wonderful place to live. However, if I was a person who didn't like anyone telling me I couldn't have a purple house with a pink roof and I couldn't have poultry/livestock, and those things would make me happy, I would certainly not be living in a subdivision. I would find a nice house on a piece of land in the county or elsewhere that would allow me those freedoms. Anyone who lives in Eldorado and wants that will never be happy.
